Message from Matt

You're in a difficult situation that needs resolution

"My mission is to give you every opportunity to resolve your dispute on terms that are mutually acceptable."
With more than 40 years in civil litigation and high-stakes negotiations, and over 20 years as a mediator, I understand what it takes to reach resolution. I know how cases evolve, how parties and insurers assess risk, and when participants are truly ready to move toward agreement together.

As a neutral, I work with you to co-create resolution. I help guide negotiations through the
inevitable speed bumps and obstacles, keeping the process steady, respectful, and productive.

Whether you are pre-litigation, in the middle of a lawsuit, or seeking resolution just weeks before trial, I'm here to help you find a clear path forward. I welcome the challenge and the opportunity to help you resolve your dispute.

Neutral Insight

Knowing When to Push, When to Listen

Every case presents unique dynamics. Matt moves fluidly between facilitative, transformative, and evaluative approaches, knowing when to listen, when to challenge, and when to help the participants reality-test their positions based on what will actually move the mediation forward and to a resolution all parties can agree upon.

Why Mediation

The power of mediation

Mediation only works when all parties come to the mediation willing to listen and compromise. No one forces anyone to agree to the resolution terms. You're not handing your fate to a judge or jury, you're co-creating an outcome everyone can accept. Matt is not the judge or advisor, only an experienced and well-trained mediator who helps guide the participants to a resolution.

01

Control over the outcome
You decide the terms, not a judge or jury

02

Faster resolution
Months or years faster than going to trial

03

Confidential process
What's said in mediation stays in mediation

04

Lower costs
Significantly less expensive than prolonged litigation

05

Preserves relationships
Problem-solving approach that maintains dignity and respect

How Mediation Works

Mediation at every stage of your dispute

Disputes evolve. Positions harden. Costs rise. Relationships strain.

Mediation can be effective early, when there is still flexibility; midstream, when communication has broken down; or late, when the risks of trial are fully understood.

Mediation means engaging in the process when it can do the most good, based on the needs of the parties, not an artificial timeline (such as required real estate contractual mediation when a dispute has not been fully investigated and/or issues understood).

Mediation timing
Stage 01

Pre-Litigation Mediation

Resolving disputes before they escalate. Address conflict early before positions harden or legal fees mount. Often even before anyone has “lawyered up” or with counsel for all sides.

Stage 02

Litigation Adjacent Mediation

Reassessing the case while litigation is underway. Step outside the pressures of discovery and trial deadlines to explore resolution with a skilled mediator who has seen every type of dispute and has the flexibility and “tool box” to help reach a compromise.

Stage 03

Pre-Trial / Last Chance Mediation

Final opportunity before trial. With full information on the table, parties are better positioned to assess risk and reach practical agreements.

Testimonials

What clients and attorneys say

My brother and I inherited a home in Novato from our father with huge debt and tons of deferred maintenance. My brother, a general contractor, moved into the home and fixed it up. Fast forward a few years and we had major issues to work out as to the value of the home, the value of the work, rent owed, etc. My brother and I mediated with Matt Wertheim (without lawyers) and in 4 hours he helped us reach a resolution/buy-out that avoided legal fees, and more importantly… maintained our relationship. He worked on the settlement terms with us for days afterwards at no charge. It was the best $3,000 we ever spent.

Matt has personally worked with me over the years on many mediations at JAMS, from reading and summarizing briefs, to note taker in session, to speaking with parties in break-out rooms, to recently co-mediating a difficult construction case. He is a quick learner with lots of savvy which he blends with his exceptional people skills. Matt possesses all of the attributes of a great mediator and I recommend him without hesitation.

Hon. Daniel Weinstein (Ret.)
JAMS Co-founder

I’ve known Matt professionally for years and have always respected his skill as both a litigator and a negotiator. When I needed a mediator for a construction case headed toward arbitration, Matt was the first person I thought of. My client, a homeowner, was quite ill but very much wanted to participate in the mediation personally. Matt didn’t hesitate. He agreed to conduct the mediation at my client’s home, and his flexibility made all the difference. Matt has all the qualities you want in a mediator: calm, creative, persistent, and genuinely committed to helping people resolve their disputes. I highly recommend Matt as he gets it done!

Matt recently resolved two difficult medical malpractice cases for my client. I am so impressed with his ability to understand the dynamics to help the parties bridge huge monetary gaps and come to a resolution. Matt will be my go-to mediator for future cases.
